The Supreme Court, on Friday the 22nd of November annuls the National Lottery Act 2005 that was enacted by the National Assembly.
The seven-member panel of the Supreme Court lead by Justice Mohammed Idris in a consensual judgment held that the National Lottery Act 2005 should no longer be enforced in all states in the Federation, with exception to the Federal Capital Territory, in respect of which only the National Assembly has the powers to make laws.
The court also held that the National Assembly therefore lacks the ultimate powers to legislate on issues relating to lottery.
The Supreme Court while still delivering the judgment further stated that the powers to legislate on issues relating to lottery only reside with the state Houses of Assembly, which possess exclusive jurisdiction over those issues.
